SAMPLE LANGUAGE FOR BEQUESTS

Over the years the major support that has come to the university largely has come in the form of bequests and other planned estate commitments. As you work with your attorney to prepare your Will or other estate plans, following is some sample bequest language. There are several areas where a bequest may positively impact Brenau University. Please contact us at 770.534.6161 so that we may discuss them with you.

Unrestricted Bequests Bequests Restricted for Endowment
“I give and bequeath to Brenau University, a Georgia corporation, located in Gainesville, Georgia, the sum of $_______. This gift shall be used to strengthen and enhance the educational mission of Brenau University in such a manner as the Board of Trustees of Brenau University may direct.”

Substitute language that you may choose to replace “the sum of $_______ ,” may include one of the following:

-- “_______ % of my adjusted gross Estate”

-- “All of the rest, residue and remainder of my Estate”

-- “_______ % of my residuary Estate”

“I give and bequeath to Brenau University a Georgia corporation, located in Gainesville, Georgia, the sum of $_______ to create an Endowed Fund to be named “_______________” which shall be invested as the Board of Trustees of the university may deem best and in keeping with its general endowment policies. Distribution from the Endowed Fund shall be made each year in accordance with the spending policies of the Board and shall be used for scholarships (or faculty development, or the study of a specific major, or another broad priority) at Brenau University. The Endowed Fund for purposes of investment, may be co-mingled with other funds of Brenau University, but the Endowed Fund shall be separately accounted for.”

Again, you may wish to substitute the phrase “The sum of $_______ ” with one of the above suggested substitute phrases.

Codicil to Last Will and Testament Savings Clause
If your attorney has your Estate planning documents up to date, you can simply draft a short Codicil or an amendment to the existing documents using the following or similar language: “I, (your name), hereby amend my last Will and Testament, executed on the (date of establishment). I direct that all provisions of that Will remain in effect but in addition direct that Brenau University, a Georgia corporation located in Gainesville, Georgia, shall receive the sum of $_______ to be used to strengthen and enhance the educational mission of the university in such a manner as the Board of Trustees of the university may direct.” We recommend that any restrictions on gifts be stated in broad and flexible terms since Brenau’s specific needs may change over time. If your bequest is restricted for a particular purpose, we ask that you incorporate a “savings clause,” which might read as follows: “If at the time of this bequest is received by Brenau University or any time thereafter, the Board of Trustees of the university determine that all or any part of the bequest can no longer be utilized to the best advantage for the institutional purposes designated herein, then all or any part of the bequest may be used for such other institutional purpose which, in the sole discretion of the Board of Trustees, shall most closely carry out my intention.” Development staff can assist you with this and other language provisions so that your wishes are always followed.
